PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. The evidence of record shows that on 30 July 1990, Orders 142-1, DA, HQ, 17
th Area Support Group, Camp Zama, APO San Francisco, discharged the applicant from the Regular Army, effective 9 August 1990. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty) which was authenticated by the applicant’s signature. Her DD Form 214 indicates that she was discharged under the provisions of Chapter 13, AR 635-200 by reason of unsatisfactory performance with a characterization of service of general, under honorable conditions. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 9 August 1990, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, and 21 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 13 contains the policy and outlines the procedures for separating individuals for unsatisfactory performance, and provides, in pertinent part, that commanders will separate a member under this chapter when, in the commander's judgment, the member will not develop sufficiently to participate satisfactorily in further training and/or become a satisfactory soldier. Army policy states that a general discharge, under honorable conditions is normally considered appropriate, but an honorable discharge may be granted in meritorious cases.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant’s record is void of the specific facts and circumstances concerning events that led to her discharge from the Army. However, the available record contains several statements made by the applicant prior to her discharge, indicating that she was unable to adjust to the Army and that she had gone to social services, the chaplain, JAG, her doctor, and her first sergeant requesting assistance in obtaining a discharge. While it does not appear that the applicant received any nonjudicial punishment, the record of counseling is indicative of a soldier who expended no effort in fulfilling her military duties and responsibilities. Given the short period of her service, the Board could not find service of sufficient merit to warrant an upgrade of the discharge being reviewed. In the absence of evidence to the contrary, the Board concluded that the applicant’s command made an assessment of her potential for becoming a fully satisfactory soldier and found that she did not demonstrate the potential for further military service. Therefore, the Board presumed government regularity in the discharge process. The Board, being convinced that the reason for discharge and the characterization of service were proper and equitable, voted to deny relief.
